In 1896 the Supreme Court upheld the social segregation of the"white and colored races" under the "separate but equal" doctrine.By a 7-1 vote, the court said that a state law that "implies merelya legal distinction" between the two races did not conflict withthe 13th amendment forbidding involuntary servitude, nor did ittend to reestablish such a condition. The court avoid thediscussion of the protection granted by the clause in the 14thamendment that forbids the states to make laws depriving citizensof their "privileges or immunities," but instead cited such laws inother states as "reasonable" exercise of their authority under thepolice power. The purpose of the 14th amendment the court said "was to enforce the absolute equality of the two races before thelaw......Laws.......requiring their separation not necessarilyimply the inferiority of either race." The argument againstsegregation laws was false because of the "assumption that theenforced separation of the two races stamps the colored race with abadge if inferiority. If this be so, it is solely because thecolored races chooses to put that construction upon it." Followingthis ruling restrictive legislation based on race continued andexpanded, and its reasoning wasn't overturned until 1954 with theBrown v Board of Education decision. The Brown's were representedin the court by Thurgood Marshall who was a civil rights advocateand later became the first black Justice on the court.
